육군 병장이던 A씨는 소셜미디어(SNS)를 통해 알게 된 성명불상의 중국인과 연락을 주고받다 2024년 8월 중국 베이징에서 그를 만났다.

A씨는 중국 정보기관 관계자를 자처한 그로부터 비공개 군사자료를 달라는 제안을 받고 이를 수락했다.

A씨는 그 무렵부터 이듬해 2월까지 총 7차례에 걸쳐 약 1726만원을 받고 한미연합연습, 유엔사 관련 자료, 한국군 단독 훈련자료 등 군사상 기밀을 유출(일반이적, 군기누설, 부정처사후수뢰)한 혐의로 재판에 넘겨졌다.

A씨는 상대방에게 아이폰을 이용한 군사상 기밀 촬영의 어려움을 토로한 뒤 손목시계형 카메라를 전달받아 군사상 기밀을 촬영하기도 한 것으로 조사됐다.

A씨는 군사법원에서 열린 1심에서 징역 5년을 선고받았다. 서울고법은 2심에서 징역 4년과 벌금 2000만원, 1907만원 추징을 선고했다. A씨는 이적의 고의가 없었다고 주장했으나 받아들여지지 않았다.

고인을 포섭하고 지령을 하달한 중국인이 (중국 정보조직의) 조직원이라는 직접적인 증거는 없으나, 인정되는 사실에 의하면 피고인이 성명불상인을 통해 군사상 기밀을 중국 정보조직으로 유출한 사실이 증명됐다”고 밝혔다.

이어 “피고인은 현역 군인으로서 보안 교육을 받아 군사상 기밀을 외부에 누설하면 안 된다는 사실을 잘 알고 있었음에도 범행을 저질러 죄책이 무겁다”며 “조직적이고 치밀하게 범행을 수행해 그 죄질도 나쁘다”고 지적했다.

A씨는 성매매알선업체를 통해 성매매 여성에게 돈을 제공한 혐의(성매매처벌법 위반)도 받았으나, 관련 증거는 압수영장에 기재된 군사기밀 관련 혐의와 객관적 관련성이 없는 별도 범죄 증거라는 이유로 무죄 판단을 받았다.
